Right of Withdrawal

Consumer information for distance purchases

This page explains the statutory Right of Withdrawal for consumers who purchase eligible goods through the Mémoire online store. It does not replace or limit separate statutory rights relating to damaged, defective or non-conforming goods.

1. Your 14-Day Right of Withdrawal

If you are a consumer, you generally have 14 days to withdraw from a distance sales contract without giving any reason, subject to the statutory exceptions described below.

For a contract for goods, the 14-day period generally begins on the day on which you, or a third party designated by you other than the carrier, acquires physical possession of the goods. If several goods from one order are delivered separately, or a product is delivered in several lots or pieces, the period is calculated in accordance with the rules applicable to the last relevant delivery.

2. How to Exercise the Right

You must communicate your decision to withdraw before the 14-day period expires. You may do this by any clear and unambiguous statement, including by using:

• the online 'Withdraw from Contract' function available on our website during the applicable withdrawal period;

• email to info@memoireperfumery.hr; or

• the model withdrawal form below, sent by email or post.

Please provide enough information for us to identify the contract, such as your full name, order number, the email address used for the order and the goods or order concerned.

3. Online Withdrawal Function

For contracts concluded through our online interface, our website provides an online withdrawal function that is intended to remain easily visible and accessible during the statutory withdrawal period. The function enables you to submit the information required to identify you and the contract, and the electronic contact details to which the confirmation should be sent.

After completing the withdrawal statement, you will be able to activate a confirmation control labelled 'Confirm Withdrawal' or another equally clear expression. After submission, we will send you confirmation of receipt on a durable medium without undue delay, including the content of your withdrawal request and the date and time of submission.

4. Effects of Withdrawal and Refund

If you validly withdraw from the contract, we will reimburse payments received from you, including the cost of the least expensive standard delivery method offered for the original order, without undue delay and no later than 14 days after we receive your notice of withdrawal.

We are not required to reimburse additional delivery costs resulting from your choice of a delivery method that was more expensive than our least expensive standard option. For sales of goods, we may withhold reimbursement until we receive the returned goods or until you provide evidence that you sent the goods back, whichever occurs first.

The refund will be made using the same payment method used for the original transaction unless you expressly agree to another method and you do not incur additional fees as a result.

5. Returning the Goods

Unless we have offered to collect the goods, you must send or hand them back without undue delay and no later than 14 days after the date on which you informed us of your decision to withdraw. The deadline is met if you send the goods before the 14-day return period expires.

Unless applicable law or a specific offer states otherwise, you bear the direct cost of returning the goods. We recommend using a traceable shipping method and retaining proof of dispatch until the refund is completed.

6. Handling and Diminished Value

You may inspect a product only to the extent necessary to establish its nature, characteristics and functioning. You may be liable for any diminished value resulting from handling beyond what is necessary for that purpose. For fragrances and cosmetics, please handle packaging and the product carefully and avoid use beyond what is reasonably necessary for inspection.

7. Statutory Exceptions

The Right of Withdrawal does not apply in the cases excluded by applicable law. Depending on the product and circumstances, relevant exceptions may include:

• goods made to your specifications or clearly personalised;

• goods liable to deteriorate or expire rapidly;

• sealed goods that are not suitable for return for health-protection or hygiene reasons where the seal has been broken after delivery, where the statutory conditions for this exception are met; and

• other cases expressly excluded by applicable consumer law.

We will not treat an ordinary opened package as automatically excluded from withdrawal unless the legal requirements for a statutory exception are actually satisfied.

8. Cancellation Before Dispatch

If you contact us before an order is dispatched, we may be able to cancel it immediately. This operational cancellation is separate from the statutory Right of Withdrawal. If the order has already been dispatched, please follow the withdrawal and return procedure above where the right applies.

9. Damaged or Non-Conforming Goods

If a product is damaged, defective, incorrect or otherwise not in conformity with the contract, contact us at info@memoireperfumery.hr. These statutory conformity rights are separate from the Right of Withdrawal and are not subject to the same reason-free return rules.
